Terms of Use
Effective: Last updated:
By installing, buying or using the Products, you agree to these terms. In these terms, “the Products” means STREAMIX Player, STREAMIX Server and the website streamix.me, and “we” means the rights holders and operators of STREAMIX.
1. License
According to the purchase option you choose, we grant you a non-exclusive, non-transferable, non-sublicensable license to use the Products for yourself or your household, on the platforms and number of devices that option covers. The Products are licensed, not sold; copyright and all other rights remain with the rights holders.
Commercial resale, further development or acting as a sales agent requires separate written permission from one of the rights holders: NOVAHELIX Corporation, STREAMIX TEAM, SAKAKIBARA, TACHIBANA or NEO, each of whom may grant permission independently. Any resale, agency or license without written permission is invalid. You can email us to check whether a particular license is valid.
2. Prohibited conduct
- Circumventing, breaking or forging license checks, or helping others do so.
- Publishing, sharing or selling license keys, or using the Products on more devices than your purchase option allows.
- Copying, modifying, distributing, renting or reselling the Products without permission.
- Reverse engineering, decompiling or disassembling the Products, except where the law allows it or a third-party open-source license requires it to be allowed (for example, analysis to debug your own modifications to LGPL components; see Third-Party Components and Open-Source Licenses).
- Using the Products to play, transmit or distribute content that infringes the rights of others.
- Attacking or overloading our website, feedback form or license service, calling them automatically without permission, or using them to send spam.
- Impersonating us, or using the STREAMIX name and logo without permission.
3. Your content
The Products provide no audio or video content. They only play and manage media you have the right to use. You are responsible for the lawful use of your media library, your servers and any third-party services you connect, such as cloud storage or metadata services.
4. Updates, suspension and termination
We may update or change features. If you breach these terms, we may deactivate the license concerned. After termination, you must stop using the Products and delete them. Fees already paid are not refunded when a license is deactivated for a breach; other refunds follow the refund rules on the purchase page.
5. Disclaimer and limitation of liability
The Products are provided as is. We are not responsible for problems caused by third-party services, your devices or your network. Our liability is limited to the amount you actually paid for the license concerned, except in cases of our intent or gross negligence and where the law (such as Japan’s Consumer Contract Act) does not allow liability to be limited.
To the fullest extent permitted by law, we are not liable for indirect damages, lost profits or lost data. If a third party makes a claim against us because you breached these terms or used the Products unlawfully, you will compensate us for the resulting losses and reasonable costs, including attorneys’ fees.
6. Changes, governing law and jurisdiction
If these terms change in an important way, we will announce it on the website and state the effective date.
Wherever you use the Products, these terms are governed solely by the laws of Japan, without regard to its conflict-of-laws rules. The district court with jurisdiction over the location of NOVAHELIX Corporation’s office in Japan has exclusive jurisdiction as the court of first instance for any dispute relating to these terms or the Products, except to the extent that mandatory law allows a consumer to sue or be sued in another court.
The Japanese version of these terms is the governing text. If language versions differ, the Japanese version prevails.
